Our website is a platform (hereinafter referred to as “Platform” where users can make utilize our food delivery service to make online orders of food and perform reservations on our platform. The Users of the website shall be referred to as “You, Your,” or “Users.”
By clicking on “Accept” button and/or checking the checkbox at any point within our platform , Users agree to be bound by the Terms and Conditions if this Agreement. Please read the entire agreement before accepting its Terms. As such, You agree to accept these Terms and Conditions whenever You undertake any activity on the Platform.
In using this Platform, You are deemed to have read, understood and agreed to the following Terms and Conditions set forth herein. Any incidental documents and links mentioned shall be accepted jointly with these Terms. You agree to the use of the Platform only in strict interpretation and acceptance of these Terms, any actions and/or Commitments made without regard to these Terms shall be at Your own risk. These Terms and Conditions form part of the Agreement between Users and Us. By accessing this platform, and/or undertaking to perform a Service provided by Us indicates Your understanding , agreement to and acceptance of the disclaimer notice and the full Terms and Conditions contained herein.

Services We Sell


We provide Users with a Platform to view food menus in islandwide restaurants, make orders, reservations and request delivery services provided by Us in the said restaurants. Users will be able to complete payment via our In-App Payment feature upon order confirmation.

Payments


Payments made via the platform’s In-App payment feature will be transacted and credited Instantly and not by any means through any sort of subscription based model. The Payment Gateway used in out In-App Payments is made exclusively by EPOSPay.

Payments made via the platform may include but not limited to, “Delivery Fees, Platform Charges, SMS Gateway Fees and Cart Total”. The User agrees that the full money owed at the time of the order will be deducted from his or her account. Depending on the kind of card, the User must input the card number, expiration date, and security code (the three numbers (CVC) on the back of the bank card), check the information and proceed to complete payment. Users will also have the choice whether to go back to the previous page. The payment request is made in real-time using EPOSPay's secure payment system; EPOSPay verifies that the bank card is valid (if no error is noted when entering the code and the card has not been stopped) and confirms registration of payment by delivering a transaction number or notifies the user that the transaction has been declined (as the case may be). The merchant accepts the transaction after EPOSPay has verified the payment, and then sends SMS confirmation of the order to the Users. The customer agrees to use his or her own bank card, of which they are the registered owner. EPOSPay and/or Merchant will not be held responsible for any fraudulent use of the said bank card. The user will be instructed on the Zippy website to choose a different payment option or use a different bank card if the bank does not make a payment or the banking centers refuse to make a payment. Until the merchant gets full payment of the amount listed for the specified order, the contents of the order will remain the Merchant's property.

The technical steps required to create the contract between you and us for the sale of any Products are as follows:

You place the order for your orders on the Site by pressing the ‘Pay & Place Order' button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Platform.

An order can be paid for by debit or credit card.
(MasterCard®, Visa®, American Express®, JCB®, Diners®, Discovers®

An order can also be paid via contactless payment. (ApplePay®, GrabPay®, GooglePay®, WechatPay®, UnionPay® and AliPay®.).

We will send you an order confirmation SMS once your order has been placed. This means that your order is confirmed and is currently being processed by our Merchants. When your order is sent out for delivery from our Merchant’s restaurants we will send you a delivery confirmation SMS, that indicates your order is being delivered.

Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the order unless we have notified you that we do not accept your order, or that it has been canceled. The contract will relate only to those Order whose delivery we have confirmed in the delivery confirmation sms.

Delivery Information


Our delivery service is only available in Singapore. We will make every effort to deliver your food by the deadlines outlined in the Terms and Conditions, but we are unable to guarantee that they won't be impacted by unanticipated problems with our food delivery carriers. As such We do not provide any kind of compensation in these situations. The delivery window and/or date specified in the order confirmation SMS that was issued to your phone number will be used to fulfill your order. The Order will be at your risk from the time of delivery of the Order to the time it is delivered to You.

Refunds & Cancellation Policy


If a Merchant has yet to accept the Users' Order, Users will have the right to a refund for a canceled Order. If Users choose to cancel the Order after it has been accepted by the Merchant, Users will note that no refunds (in whole and/or in part) will be issued to them, which includes (but not limited to) the delivery fee of the said canceled Order. In the event that a cancellation is required, it will be at the Zippy and/or Merchant’s discretion. In the event that a cancellation is required, it will be at the Zippy and/or Merchant’s discretion.

When a refund is required in the event of cancellation, Zippy will disregard the order's total value, and may only refund a maximum of SGD200 (determined on a case-by-case basis) for items purchased and delivered through the Zippy Service. Zippy reserves the right to determine and modify the maximum amount of refund at any time. Prior to processing any refund, Zippy may require you to provide additional information or supporting documents, such as picture proof of physical receipts for Pick-Up Orders. If you do not provide such additional information or supporting documents, we may, in our sole discretion, refuse to process any refund.

Unavailability of products


The merchant retains the right to periodically and at any time alter the product portfolio. Every product or product range will have a specific offer's declared validity duration, which may be limited for some deals. The Merchant agrees to fulfill orders placed through the website only if there are sufficient supplies. Rarely, a product that appears to be available on the website may no longer be so after an order has been confirmed. The Merchant agrees to send the Users an SMS as soon as possible if one or more of the ordered products become unavailable within the specified time frame. Except in cases where the User specifically requests to change his or her order to a different product suggested by the merchant, the transaction will be automatically canceled and the User will be refunded within 30 days at the latest after full settlement of the amount paid. The User understands and agrees that there will be no fees associated with such cancellations, and that subject to the foregoing, receiving the client's payment back in full shall be conclusive. The User renounces any claims against the Merchant for fees or other expenses.

Third party involved in providing service


We engage third party carrier service providers to deliver the orders confirmed and paid by the Users to their said Delivery Address. The carrier services we engage are (but not limited to) “Lalamove, Milkrun and PandaGo ''.

Force Majeure


In the event of a force majeure event (an occurrence beyond our reasonable control), we will not be held liable for the performance of any obligations under these terms and conditions. This includes, but is not limited to, strikes, lockouts, malfunctions of third-party systems or networks, acts of God, fire, earthquake, storm, flood, or other natural disaster, civil unrest, acts networks, acts of God, fire, earthquake, storm, flood, or other natural disaster, civil unrest, acts networks, acts of God, fire, earthquake, storm, flood, or other natural disaster, civil unrest, acts of terrorism, maliciously sabotaging or damaging equipment or data, as well as damage to or destruction of the preexisting (a "Force Majeure Event").

Singapore law shall govern the Terms & Conditions and any issues resulting from or related to the Terms & Conditions. Regarding any such issue, you consent to provide Singaporean courts sole jurisdiction. No aspect of the Terms & Conditions may be enforced by a third party who is not a party under the Contract (Rights of Third Parties) Act.

We may not be obligated and/or willing to participate in an alternative consumer dispute resolution by a consumer arbitration organization, to the degree permitted by the applicable law. We continually work to settle potential conflicts with our consumers directly.
